Terms of Use
Effective July 13, 2026
PastPlate helps you remember your own dining experiences. It does not guarantee ingredient accuracy, food safety, restaurant availability, or that a past preparation will be repeated.
1. Acceptance
By downloading, accessing, or using PastPlate, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use PastPlate.
2. Eligibility
You must be legally able to enter into these Terms. The current app is not directed to children under 13.
3. License
Subject to these Terms and any applicable App Store rules, PastPlate grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. You may not copy, modify, distribute, sell, lease, reverse engineer, interfere with, or misuse PastPlate except where applicable law permits otherwise.
4. Personal records and acceptable use
You are responsible for information you add to PastPlate and for ensuring that you have the right to use any photos or content you include. Do not use PastPlate to violate law, infringe rights, introduce malicious code, attempt unauthorized access, or disrupt the app or website.
5. Restaurant, menu, and food information
Restaurant details may come from you or third-party services. Names, hours, addresses, menu items, recipes, prices, ingredients, and preparation methods can change. PastPlate does not guarantee that restaurant or menu information is complete, current, or accurate.
6. Dietary and allergen disclaimer
PastPlate is a personal memory tool, not a medical, dietary, or food-safety service. Notes about allergies, ingredients, restrictions, or past experiences are not a guarantee that a dish is currently safe. Cross-contact and recipe changes may occur. Contact the restaurant directly and seek professional medical advice when appropriate.
7. Subscriptions and introductory offers
PastPlate may require an active subscription after an introductory trial. Available products, prices, trial eligibility, billing periods, taxes, and renewal terms are shown by Apple at the time of purchase and may vary by region.
Subscriptions automatically renew unless canceled in accordance with Apple’s terms. You can manage or cancel a subscription through your Apple Account settings. Deleting the app does not cancel a subscription.
8. Restoring purchases and access
PastPlate provides a Restore Purchases option for eligible App Store transactions. Purchase recognition depends on Apple services, the Apple Account used for the original transaction, network availability, and valid transaction information.
If subscription access ends, PastPlate may limit the creation of new records or use of paid features. PastPlate is designed to preserve reasonable access to existing local history, backup tools, legal information, and support, although features and policies may change over time.
9. Local data and backups
You are responsible for protecting your device and maintaining backups. Exported PastPlate backups are not encrypted by the app. Importing a backup replaces or modifies local data as described in the app. Although PastPlate includes validation and rollback protections, no backup or restoration process is guaranteed to be error-free.
10. Third-party services
PastPlate may use third-party services, including Apple services and Google Maps Platform. Those services are governed by their own terms and privacy policies. PastPlate is not responsible for third-party availability, acts, omissions, content, or policies.
11. Intellectual property
PastPlate, its logo, design, software, text, graphics, and related materials are owned by or licensed to PastPlate and are protected by intellectual-property laws. Restaurant names and third-party trademarks belong to their respective owners.
12. Feedback
If you provide ideas or feedback, you grant PastPlate permission to use that feedback without restriction or compensation, while we remain responsible for handling any personal information under the Privacy Policy.
13. Changes and availability
We may add, change, suspend, or discontinue features, pricing, or availability. We may update these Terms, with the effective date posted on this page. Continued use after an update means you accept the revised Terms to the extent permitted by law.
14. Disclaimer of warranties
To the maximum extent permitted by law, PastPlate is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or food safety.
15. Limitation of liability
To the maximum extent permitted by law, PastPlate and its owners, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, personal injury, allergic reaction, illness, or other harm arising from or related to use of PastPlate, restaurant information, or reliance on past dining experiences.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PastPlate and its owners, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of PastPlate, violation of these Terms, or infringement of another person’s rights.
17. Governing law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
